1. Definitions

1.1 “Buyer” means the individual or organisation who buys or agrees to buy books from the Seller
1.2 “Consumer” shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977
1.3 “Contract” means the contract between the Seller and the Buyer for the sale and purchase of books incorporating these Terms and Conditions
1.4 “Books” means the articles that Akra-Global Ltd. the Buyer agrees to buy from the Seller

1.6 “Terms and Conditions” means the terms and conditions of sale set out in this agreement

2. Acceptance of Terms

By accessing and using our website and services, placing an order, or accepting delivery of books, you agree to be bound by these Terms and Conditions. Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer. If you do not agree to these terms, please do not use our website or services.

We are registered in England and Wales. Our business serves customers globally, with specific provisions for UK, EU, and international markets.

4. Ordering and Payment

4.1 Order Placement

All orders for books shall be deemed to be an offer by the Buyer to purchase books pursuant to these Terms and Conditions and are subject to acceptance by us. We may choose not to accept an order for any reason. A completed order does not mean an accepted order by us. When books are dispatched, we accept the order.

4.2 Availability

Where books ordered by the Buyer are not available from stock, the Buyer shall be notified and given the option to either wait until the books are available from stock or cancel the order and receive a full refund within 30 days.

4.3 Pricing and Currency

All prices are displayed in British Pounds (£) unless otherwise stated. For international customers, your payment provider will convert the amount using current exchange rates at the time of transaction. We may also display prices in other currencies (USD, EUR, etc.) as estimates only – the final charge will be in GBP.

Prices include UK VAT where applicable. International customers may be charged local taxes, duties, and fees by their local authorities – these are not included in our prices and are the customer’s responsibility.

4.4 Payment

We accept all major debit/credit cards, PayPal, and other payment methods displayed at checkout. Payment for all orders will be taken upfront at checkout. This includes in-stock products and products with future publication dates. By proceeding through checkout, you agree to have payment taken upfront with the knowledge that products may not ship out until the delivery date specified in the product listing.

4.5 Order Confirmation

After your order is received, we shall confirm by email the details of your order, description, and price for the books.

5. EU Product Safety Information (GPSR Compliance)

For customers ordering books for delivery to European Union member states, we comply with the General Product Safety Regulation (GPSR) EU/2023/988, which came into effect on December 13, 2024.

5.1 Product Safety Requirements

All physical books sold to EU customers meet the general safety requirements under GPSR. We maintain technical documentation including:

Product risk assessments for all book titles
Safety information and certifications from our suppliers/printers
Traceability records including batch numbers and ISBN information

5.3 Product Information

All books sold to EU customers include the following information on the product or packaging:

Publisher/manufacturer name and address (our UK details)
EU authorized representative contact details (Irish address above)
Product identification (ISBN, batch information)
Safety warnings where applicable
Instructions for safe use and disposal where relevant

5.4 Safety Documentation

We maintain detailed technical files for all products sold in the EU market for a minimum of 10 years from the date of placing on the market. This documentation is available to market surveillance authorities upon request through our EU representative.

5.5 Product Recalls and Safety Issues

If you believe a book purchased from us presents a safety risk, please contact us immediately at contact@arka-global.co.uk or our EU representative at [Friend’s Email]. We maintain procedures for rapid product recall if necessary and will cooperate fully with EU market surveillance authorities.

6. Delivery

6.1 UK Delivery

Books will be dispatched within 3-5 working days (it may take slightly longer during busy periods) and will normally be delivered within 2-3 working days of acceptance of order using Royal Mail or other UK delivery services.

6.2 International Delivery

Books delivered outside the UK and EU will be dispatched within 5-10 working days and delivery times vary by destination:

Europe (non-EU): 7-14 working days
North America: 10-21 working days
Australia/New Zealand: 14-28 working days
Rest of World: 14-35 working days

Delivery times are estimates and may vary due to customs processing, local postal services, and other factors beyond our control.

6.3 Delivery Address

Delivery of books shall be made to the address specified in your order and you shall make all arrangements necessary to take delivery of books whenever they are tendered for delivery. Items from the same order may be delivered separately. You must provide a complete and accurate delivery address including postal/ZIP code.

6.4 International Shipping Costs

Shipping costs are calculated at checkout based on destination and order weight.

6.5 Customs, Duties, and Import Taxes

Important: International orders may be subject to import duties, customs fees, taxes, and handling charges imposed by the destination country. These charges are:

Not included in our prices or shipping costs
Your responsibility as the customer
Determined by local customs authorities and vary by country
Payable directly to customs/courier upon delivery or before release

We have no control over these charges and cannot predict their amount. We recommend checking with your local customs office for applicable rates before ordering.

6.6 Export Restrictions

We comply with UK export regulations. Some books may be restricted for export to certain countries due to copyright, licensing, or regulatory reasons. If we cannot ship your order due to restrictions, we will provide a full refund.

6.7 Risk and Title

Title and risk in the books shall pass to you upon delivery of the books. For international orders, this includes successful clearance through customs in your country.

7. Returns, Cancellation and Refunds

7.1 Consumer Rights by Region

UK Customers: You have statutory rights under the Consumer Rights Act 2015. These Terms and Conditions do not affect those rights. For further information, contact your local authority Trading Standards department or Citizens Advice.

EU Customers: You have rights under applicable EU consumer protection legislation, including a 14-day withdrawal period for distance purchases. Nothing in these terms affects your mandatory consumer rights under the laws of your EU member state.

International Customers: These terms apply subject to any mandatory consumer protection laws in your country of residence. Where local laws provide greater consumer protection, those laws will prevail.

7.2 Cooling-Off and Return Periods

UK & EU customers: Legal right to cancel within 14 days of receiving books.
International customers: 21 days from receipt to cancel/return (unless local law provides longer period).

All returns must be in original condition unless books were damaged, defective, or incorrectly supplied.

7.3 How to Cancel

Contact us by email at support@arka-global.co.uk . Include your order number, delivery address, and reason for return. Your cancellation is effective from the date you notify us.

7.4 Returning Books

Return Shipping Responsibility:

UK customers: You pay return shipping unless books were damaged.
EU customers: You pay return shipping unless books were damaged.
International customers: You pay return shipping costs for all returns (including damaged items – we will reimburse after inspection)

Important for International Returns:

Return shipping costs may be significant and could exceed the book value
Items may be subject to customs duties on return
We recommend considering return costs before requesting returns
Use tracked/insured shipping – we’re not responsible for items lost in return transit

7.5 Return Process

1. Contact us for return authorisation
2. Package books securely in original condition
3. Include copy of order confirmation/invoice
4. Send to our returns address (provided upon authorization)
5. Obtain tracking number and proof of posting

7.6 Refunds

Refund Timing:

UK/EU: Within 14 days of receiving returned books
International: Within 21 days of receiving returned books

Refund Method: Original payment method where possible

Refund Amount:

Book price only
Currency conversion at time of refund may differ from original charge

Return Shipping Reimbursement:

UK/EU: Reimbursed if books were damaged.
International: Not reimbursed unless specifically agreed in writing.

7.7 Exceptions

Cannot be returned unless faulty:

Personalised or custom books
Sealed items that have been opened (where applicable)
Books damaged by customer use

7. Damaged Books

7.1 Inspection

Please inspect books immediately upon receipt and contact us within 7 working days if books are damaged, defective, or do not match your order.

7.2 Our Response

If books are faulty, damaged, or incorrectly supplied, we will provide a full refund including original delivery costs and return postage, or send a replacement free of charge.

8. Pre-Orders and Future Publications

8.1 Pre-Order Terms

For books with future publication dates, payment is taken at the time of ordering. Books will be dispatched as soon as they become available.

8.2 Price Protection

If a publisher increases the price of a pre-ordered book, we will contact you to confirm whether you wish to proceed at the new price.

8.3 Cancellation of Pre-Orders

You may cancel pre-orders at any time before dispatch for a full refund.

9. Intellectual Property

9.1 Website Content

All content on our website, including text, graphics, logos, and images, is our property or used with permission and is protected by copyright laws.

9.2 Book Content

Books contain copyrighted material owned by their respective authors and publishers. Purchase grants you the right to personal use only.

10. Privacy and Data Protection

We are committed to protecting your privacy. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with UK GDPR and the Data Protection Act 2018.

11. Limitation of Liability

11.1 Consumer Rights Protection

Nothing in these Terms and Conditions excludes or limits:

Our liability for death or personal injury resulting from our negligence
Our liability for fraud or fraudulent misrepresentation

11.2 Our Liability – General

Subject to clause 11.1, our total liability for any claim is limited to the greater of:

11.3 Excluded Losses

Subject to clause 11.1, we are not liable for:

Loss of profits, revenue, or business
Loss of anticipated savings
Loss of business opportunity
Loss of goodwill or reputation
Any indirect, consequential, or special losses
Losses arising from delays, customs issues, or postal service problems beyond our control

11.4 International Shipping Limitations

For international orders, our liability is further limited by:

Customs and import processes beyond our control
Local postal service reliability and delivery standards
Currency fluctuation effects on refunds
International return shipping complications

We strongly recommend customers consider shipping insurance for high-value international orders.

11.5 Warranties

We warrant that books will correspond to their description at the time of dispatch. Books are sold with full publisher warranties where applicable. We do not provide any additional warranties beyond those required by applicable consumer protection laws.

You may create an account to enhance your shopping experience. You are responsible for maintaining the security of your account and all activities under your account.

You must provide accurate information and keep it up to date. We may suspend accounts that contain false information.

13. Prohibited Uses

You agree not to:

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including acts of God, strikes, pandemics, government actions, or supplier failures.

UK Customers: These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the English courts.

EU Customers: These Terms and Conditions are governed by English law where permitted, subject to the mandatory consumer protection laws of your country of residence and the jurisdiction of courts in your member state for consumer disputes.

International Customers: These Terms and Conditions are governed by English law. However, nothing in these terms excludes or limits your rights under the mandatory laws of your country of residence.

For business customers and non-consumer disputes: English courts have exclusive jurisdiction.

For consumer disputes: While we prefer English law and courts, if the law of your country of residence provides you with mandatory consumer protection that cannot be excluded, those protections will apply. You may bring proceedings in your local courts if required by your local consumer protection laws.

15.4 Class Actions and Collective Proceedings

To the fullest extent permitted by applicable law, any dispute must be brought individually and not as part of a class action, collective proceeding, or representative action. This clause may not apply where prohibited by mandatory local consumer protection laws.
